Con el presente auto se declaró de oficio la nulidad de todo lo actuado en el expediente de revisión de la referencia, por cuanto no se resolvió el impedimento que formuló la magistrada Diana Fajardo Rivera, previamente a decidir si la Sala Plena asumía el conocimiento del asunto.
Consideró la Corte que la falta de pronunciamiento sobre la configuración o no de la causal planteada podría poner en riesgo el principio de imparcialidad, esencialmente vinculado al debido proceso, así como la transparencia en las actuaciones propias de la función judicial, como garantía de aquel.

- SEGUNDO. ORDENAR devolver la actuación a la Sala Segunda de Revisión para que se resuelva el impedimento planteado por la magistrada Diana Fajardo Rivera y continuar con el trámite y las actuaciones procesales que correspondan.
